Interpretation and Definitions
The words of which the initial letter is capitalized have meanings defined under the following
conditions. The following definitions shall have the same meaning regardless of whether they
appear in singular or in plural.
Definitions
For the purposes of this Privacy Policy:
“Account” means the account consisting the username and password created at the Website to allow the Applicant to access and rights to view and access the Service or parts of the Service.
“Affiliate” means an entity that controls, is controlled by or is under common control with a
party, where "control" means ownership of 50% or more of the shares, equity interest or other
securities entitled to vote for election of directors or other managing authority. Affiliate shall
also include the associated entities, any other subsidiaries, joint venture partners or other
companies that the party has the power to control or that are under common control such the
party.
“IRDA” means to Iskandar Regional Development Authority with its business address at Iskandar Malaysia Expatriate Service Center, Level 1, Wisma Sunway Iskandar Puteri, Persiaran Medini 5, Sunway City Iskandar Puteri, 79259, Iskandar Puteri, Johor Darul Ta'zim.
“Cookies” are small files that are placed on the Applicant’s computer, mobile device or any
other device by a website, containing the details of the Applicant’s browsing history on that
website among its many uses.
“Device” means any device that can access the Service such as a computer, a cellphone or adigital tablet.
"Personal Data” means any information that relates to an identified or identifiable individual.
“Service” means the services which IRDA is to process, examine, consider, approve and/or
such other action to be taken by IRDA for the Online Application through the internet via the
Website after the submission of the Online Application by the Applicant.
“Online Application” means the application and submission for the approval of the expatriate
working visa or permit to work in Malaysia and such application shall be made, submitted and
paid by the Applicant through the internet via the Website.
"Service Provider” means any natural or legal person who processes the data on behalf of
IRDA. It refers to third-party companies or individuals employed or engaged by IRDA to
facilitate the Service, to provide the Service on behalf of IRDA, to perform services related to
the Service or to assist IRDA in analyzing how the Service is used.
"Usage Data” means data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
“Website” means http://www.xpatnova.com.my/irda .
"The Applicant” means any user, visitor, any person and/or the individual accessing the
Website or using the Service, or the company, or other legal entity on behalf of which such
individual is accessing or using the Service, as applicable.
Collecting and Using the Applicant’s Personal Data
Personal Data
While using the Service, IRDA may ask the Applicant to provide IRDA with certain personally
identifiable information that can be used to contact or identify the Applicant. Personally
identifiable information may include, but is not limited to Email address, First name and last
name, Phone number, Address, State, Postal code, City, Usage Data, identity card number or
passport number, birth date, gender, or such other required information. The provision of the
personal information is voluntary - if the Applicant chooses to not provide IRDA with his/her
personal information or any other information requested, the Applicant may not be able to use
the Service.
Usage Data
Usage Data is collected automatically when using the Service.
Usage Data may include information such as the Applicant’s Device's Internet Protocol address
(e.g. IP address), browser type, browser version, the pages of the Service that the Applicant
visits, the time and date of the Applicant visits, the time spent on those pages, unique device
identifiers and other diagnostic data.
When the Applicant accesses the Service by or through a mobile device, IRDA may collect
certain information automatically, including, but not limited to, the type of mobile device the
Applicant uses, the mobile device unique ID, the IP address of the mobile device, the mobile
operating system, the type of mobile Internet browser , unique device identifiers and other
diagnostic data.
IRDA may also collect information that the Applicant browser sends whenever the Applicant
visit the Website or when the Applicant accesses the Website by or through a mobile device.
Tracking Technologies and Cookies
IRDA uses Cookies and similar tracking technologies to track the activity on Website and store
certain information. Tracking technologies used are beacons, tags, and scripts to collect and
track information and to improve and analyze the Service.
The technologies may include:

Cookies or Browser Cookies. A cookie is a small file placed on the Applicant’s Device.
The Applicant can instruct his/her browser to refuse all Cookies or to indicate when a
Cookie is being sent. However, if the Applicant does not accept Cookies, the Applicant
may not be able to use some parts of the Website and/or the Service.

Web Beacons. Certain sections of the Website or the Service or emails may contain small
electronic files known as web beacons (also referred to as clear gifs, pixel tags, and singlepixel gifs) that permit IRDA to count users who have visited those pages or opened an
email and for other related website statistics.
Use of the Applicant’s Personal Data
IRDA may use Personal Data for the following purposes:

i) To provide and maintain the Service:
including to monitor the usage of the Website and/or the Service.

ii) To manage the Applicant’s Account:
to manage the Applicant’s registration as a user
of the Service. The Personal Data provided by the Applicant may give the Applicant
access to different functionalities of the Service that are available to the Applicant as a
registered user that are available on the Website.

iii) For the performance of a contract:
the development, compliance and undertaking of
the purchase contract for the products, items or services the Applicant has purchased
or of any other contract with IRDA through the Service.

iv) To contact the Applicant:
To contact the Applicant by email, telephone calls, SMS,
or other equivalent forms of electronic communication, such as a mobile application's
push notifications regarding updates or informative communications related to the
functionalities, products or contracted services, including the security updates, when
necessary or reasonable for their implementation.

v) To provide the Applicant
with news, special offers and general information about
other goods, services and events which IRDA may offer that are similar to those that
the Applicant has already purchased or enquired about unless the Applicant has opted
not to receive such information.

vi) To manage the Applicant’s requests:
To attend and manage the Applicant’s requeststo IRDA.

vii) For business transfers:
IRDA may use the Applicant’s information to evaluate or
conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale
or transfer of some or all of IRDA’s assets, whether as a going concern or as part of
bankruptcy, liquidation, dissolution or similar proceeding, in which Personal Data held
by IRDA about the Service users is among the assets transferred.

viii) For other purposes:
IRDA may use the Applicant’s information for other purposes,
such as data analysis, identifying usage trends, determining the effectiveness of
IRDA’s promotional campaigns and to evaluate and improve IRDA’s Service,
products, services, marketing and the Applicant’s experience.
IRDA may share the Applicant’s personal information in the following situations:

i) With Service Providers:
IRDA may share the Applicant’s personal information with
Service Providers to monitor and analyze the use of the Website and/or the Service, to
contact the Applicant. These third parties companies and individuals may have access
to the Applicant’s personal information. The reason is to perform the tasks assigned to
them on IRDA behalf. However, they are obligated not to disclose or use the
information for any other purpose

ii) For business transfers:
IRDA may share or transfer the Applicant’s Personal
Information in connection with, or during negotiations of, any merger, sale of IRDA
assets, financing, or acquisition of all or a portion of IRDA’s business to another
company.

iii) With Affiliates:
IRDA may share the Applicant’s information with IRDA’s Affiliates,
in which case IRDA will require those Affiliates to honor this Privacy Policy.

iv) With business partners:
IRDA may share the Applicant’s information with IRDA’s
business partners to offer the Applicant certain products, services or promotions.

v) With other users:
when the Applicant shares personal information or otherwise
interact in the public areas with other users, such information may be viewed by all
users and may be publicly distributed outside.

vi) With the Applicant’s consent:
IRDA may disclose the Applicant’s personal
information for any other purpose with the Applicant’s consent.
Retention of the Applicant’s Personal Data
IRDA will retain the Applicant’s Personal Data only for as long as is necessary for the purposes
set out in this Privacy Policy. IRDA will retain and use the Applicant’s Personal Data to the
extent necessary to comply with the legal obligations, resolve disputes, and enforce any legal
agreements and policies.
IRDA will also retain Usage Data for internal analysis purposes. Usage Data is also retained
for the purpose to strengthen the security or to improve the functionality of the Website, the
Service, or IRDA are legally obligated to retain this data.
Disclosure of the Applicant’s Personal Data
Business Transactions
If IRDA is involved in a merger, acquisition or asset sale, the Applicant’s Personal Data may
be transferred.
Law enforcement
Under certain circumstances, IRDA may be required to disclose the Personal Data if required
to do so by law or in response to valid requests by public authorities.
Other legal requirements
IRDA may disclose the Applicant’s Personal Data in the good faith belief that such action is
necessary to:
- i) Comply with a legal obligation
- ii) Protect and defend the rights or property of IRDA
- iii) Prevent or investigate possible wrongdoing in connection with the Service
- iv) Protect the personal safety of users of the Service or the public
- v) Protect against legal liability
Security of the Applicant’s Personal Data
The security of the Applicant’s Personal Data is important to IRDA, but remember that no
method of transmission over the Internet, or method of electronic storage is 100% secure. While
IRDA strive to use commercially acceptable means to protect the Applicant’s Personal Data,
IRDA cannot guarantee its absolute security.
Children's Privacy
The Service does not address anyone under the age of 18. If the Applicant is under the age of
18, the Applicant should not use the Services, register, or submit personal information to IRDA.
IRDA does not knowingly collect personally identifiable information from anyone under the
age of 18. If the Applicant is a parent or guardian and the Applicant is aware that the child has
provided IRDA with Personal Data, please contact IRDA. If IRDA becomes aware that IRDA
has collected Personal Data from anyone under the age of 18 without verification of parental
consent, IRDA take steps to remove that information from IRDA’s servers.
If IRDA needs to rely on consent as a legal basis for processing the Applicant’s information
and the Applicant’s country requires consent from a parent, IRDA may require the Applicant’s
parent's consent before IRDA collects and uses that information.
Links to Other Websites
The Website and/or the Service may contain links to other websites that are not operated by
IRDA. If the Applicant clicks on a third party link, the Applicant will be directed to that third
party's site. IRDA strongly advise the Applicant to review the Privacy Policy of every site the
Applicant visits.
IRDA has no control over the third-party link and therefore assume no responsibility for the
content, privacy policies or practices of any third party sites or services.
Changes to this Privacy Policy
IRDA may update those Privacy Policy from time to time.
The Applicant is advised to review this Privacy Policy periodically for any changes. Changes
to this Privacy Policy are effective when they are posted on this page.
The Applicant’s Consent
The Applicant agrees and consents IRDA to contact the Applicant for any of the purposes of
the Services, statistical or survey purposes to make necessary improvement and services to the
Applicant, provision of website content or administration of the Services. The Applicant
consents to such contact whether by telephone, email or in writing. The Applicant confirms that
the Applicant does not and will not consider any of the above as being a breach of any of the
Applicant’s rights under the law.
By submitting the Applicant’s personal information to IRDA and/or by registering an Account
with IRDA, the Applicant accepts and confirms that the Applicant has read the terms and
conditions in this page and that the Applicant consents to IRDA collecting and processing the
Applicant’s personal information in accordance with this Privacy Policy and the terms and
conditions herein contained.
